Welcome to the Edwinterfest website.  The website and its associated mobile applications (each an “App”) (collectively we refer to the website and the Apps as the "Website") are owned and operated by Unique Assembly Limited (company number SC740061).  

The Website is provided to assist customers in gathering winter festival Events information and searching for and booking tickets for events that are organised by Unique Assembly Limited and for no other purnb poses. The terms "we", "us", "our" and "Unique Assembly" refer to Unique Assembly Limited. The term "You" refers to the customer visiting the Website and/or purchasing and/or holding a Ticket(s) for an Event.  

Unique Assembly with its registered office at 2 Roxburgh Place, Edinburgh, Midlothian, EH8 9SU, is the “Promoter” of Edinburgh’s Christmas and Edinburgh's Hogmanay official events (each an “Event” and collectively the “Events”).  

 

Your Obligations 

Your use and interaction with the Website is offered to you conditioned upon your acceptance without modification of any/all the terms, conditions, and notices set forth below (collectively, the "Terms and Conditions"). 

By accessing or using this Website in any manner, you agree to be bound by these Terms and Conditions and represent that you have read and understood its terms.  

Please read these Terms and Conditions carefully, as they contain information concerning your legal rights and limitations on these rights, as well as a section regarding applicable law and jurisdiction of disputes. If you do not accept these Terms and Conditions, you are not authorised to use the Website or make any transaction through it. 

The content and information on this Website (including, but not limited to, messages, data, information, text, music, sound, photos, graphics, video, maps, icons, software, code, Logos or other material), as well as the infrastructure used to provide such content and information, is proprietary to us.

Our Rights 

These Terms and Conditions also set out terms and conditions in connection with the purchase of a Ticket and attendance at Events or Venues/Event Arenas and by purchasing a Ticket, you acknowledge that such terms and conditions apply. 

 

We may change or otherwise modify these Terms and Conditions in the future in accordance with the provisions herein, and you understand and agree that your continued access or use of this Website after such change signifies your acceptance of the updated or modified Terms and Conditions. We will note the date that revisions were last made to these Terms and Conditions at the bottom of this document, and any revisions will take effect upon posting.  

 

In these terms and Conditions: (i) “Event Partner” means any person (including natural persons or incorporated or unincorporated entities) involved in the provision of an Event; (ii) “Ticket” means a physical or electronic ticket to an Event; (iii) “Venue” means the space, facilities and/or location where an Event takes place and “Venues” shall be interpreted accordingly. 

 

 

Use of Website 

As a condition of your use of this Website, you warrant that: 

all information supplied by you on this Website is true, accurate, current and complete  

if you have an account on the Website, you will safeguard your account information and will supervise and be completely responsible for any use of your account by anyone other than you,  

you are 16 years of age or older in order to register for an account and contribute to our Website and  

you possess the legal authority and capacity to enter into a binding contract and to use this Website in accordance with all terms and conditions herein. 

 

Unique Assembly does not knowingly collect the information of anyone under the age of 16.   

 

We retain the right at our sole discretion to deny access to anyone to this Website and the services we offer, at any time and for any reason, including, but not limited to, for violation of these Terms and Conditions. 

 

Where Unique Assembly may provide details of Ticket prices and other charges on the Website, such information is provided for convenience and information purposes only. Unique Assembly in no way guarantees or represents that this information is complete, accurate or correct and is not in any way responsible for content or services provided on such third-party websites. 

 

We may from time to time display additional terms and conditions on the Website or any App - for example, in connection with a specific promotion or the sale of goods or services. If the terms and conditions for use of the Website or App should conflict in any way with such additional terms, then the additional terms will prevail. 

 

Unique Assembly does not represent or warrant that use of this Website including any App will be error-free or without interruption and shall not be liable to any user for any inability to access and/or make a purchase through this Website or any App.   

 

You acknowledge that we cannot guarantee and therefore shall not be in any way responsible for the security or privacy of the Website and any information provided to or taken from the Website by you.

Occasionally, we may publish images or text for which the copyright is not owned by us. Where this is done, and where practicable, we will acknowledge the copyright owner.

The Website may contain links to third-party websites or resources which are operated and owned by independent ticketing agents or other festival sites. Such third parties may charge you a fee for use of certain content or services provided on their websites. Customer Accounts 

In order to use some parts of the Website or to purchase tickets you may be required to create an account. You must never use another Website user's account without obtaining their prior consent. You must provide full and accurate information when you create your account with us. You are solely responsible for the activity that occurs on your account, and we advise you keep your account password secure. You must notify us immediately if you are aware of any unauthorised use of your account. 

 

Limit Of Liability of Use 

Whilst we will use reasonable endeavours to verify the accuracy of any information we place on the website, we make no warranties, whether express or implied in relation to its accuracy. 

 

Indemnity

These Terms and Conditions, and any terms and conditions applicable to the relevant Venue and the Promoter and any specially agreed terms constitute the entire agreement between the parties in connection to, its subject matter and supersede any previous terms and conditions, agreement or arrangement between the parties. Each of the parties agrees that it has not entered into these Terms and Conditions in reliance on, and shall have no remedy in respect of, any statement, representation, covenant, warranty, undertaking or indemnity (whether negligently or innocently made) by any person (whether party to any contract entered into pursuant to these Terms and Conditions or not) other than as expressly communicated by Us to You before You have completed Your purchase or set out in these Terms and Conditions. Nothing in this clause shall operate to limit or exclude any liability for fraud. 

 

If any provision of these Terms and Conditions is found by a competent court to be invalid or unenforceable, that provision shall be deemed to be omitted from these Terms and Conditions and this shall not prevent the other provisions from continuing to remain in full force and operate separately.  

 

If any provision of these Terms and Conditions is or becomes illegal, invalid or unenforceable pursuant to the law of any applicable jurisdiction, this shall not affect or impair the legality, validity or enforceability in that jurisdiction of any other provision of these Terms and Conditions. 

 

These Terms and Conditions are governed by and shall be construed in accordance with the laws of Scotland and you agree to submit to the non-exclusive jurisdiction of the courts of Scotland in relation to any dispute arising out of or in connection with these Terms and Conditions.

TICKETS CONDITIONS OF PURCHASE 

All Tickets are sold subject to availability and to these Terms and Conditions. These Terms and Conditions should be read carefully prior to purchase and any queries relating to them should be raised with us prior to purchase.  

By placing an order to purchase any Ticket(s) this constitutes your agreement to these Terms and Conditions. A valid Ticket must be produced to get into an Event or attraction. Please notify us of any access requirements at the time of booking.  

 

Ticket Information 

It is your responsibility to check Your Ticket(s) as mistakes cannot always be rectified after purchase.  

 

Removing any part of, damaging, altering or defacing the Ticket may invalidate Your Ticket. 

 

We will not be responsible for any Ticket that is lost, stolen or destroyed or in the case of electronic Tickets corrupted, deleted or otherwise inaccessible from your device. Unique Assembly only accept responsibility for Tickets bought from one of its own managed sales points. Any queries regarding Tickets purchased from other sales points such as Ticketmaster or Assembly Festival, must be directed back to the relevant box office. 

 

It is not possible to issue a duplicate Ticket(s). For example, for non-seated Events where there is a possibility of both the original and duplicate Ticket(s) being used, compromising the licensed capacity of the venue/event arena. 

 

A valid ticket, wristband or pass to the applicable Event must be carried at all times. Failure to produce a ticket, wristband or pass, when so requested by Event staff, may result in the person being removed from an Event, without right to any ticket refund. Lost or misplaced tickets will not be replaced under any circumstances.

Where a Ticket is purchased as an electronic Ticket it is each Ticket holder’s responsibility to ensure they have an operational smart phone or other appropriate technology required to display their Ticket for entry to an Event.   

For some events, tickets may be sold as part of a "Package" (where a ticket for an event(s) is sold together with concessions, merchandise or other valuable benefits such as exclusive arrangements, as an inclusive package at an inclusive price). 

 

Ticket Pricing 

The price of the Ticket shall be the price set at the time We accept Your order. All advertised prices are inclusive of any applicable taxes and fees (where applicable) but exclusive of any, Ticket booking fees, collection or delivery costs. 

 

No order will be accepted until We have received full payment in cleared funds. We reserve the right to cancel any booking which We reasonably suspect to have been made fraudulently. 

 

If the amount you pay for a Ticket is incorrect regardless of whether because of an error in a price posted on the Websites or otherwise communicated to You, or You are able to order a Ticket before its scheduled on-sale or presale date or You are able to order a Ticket that was not supposed to have been released for sale, then We will have the right to cancel that Ticket (or the order for that Ticket) and refund to You the amount that You paid. This will apply regardless of whether it is because of human error or a transactional malfunction of this website or other Unique Assembly-operated system. 

 

All prices currently advertised are inclusive of VAT (where applicable). We currently do not offer VAT exemption for international customers or any geographical regions. The grand total of the order is the price of the Ticket(s) ordered plus any applicable booking fees, payment processing fees or delivery fees. 

 

We currently only accept the following payment cards: Visa, Mastercard, Maestro/Solo, Amex. The price charged to customers outside the United Kingdom will be subject to the exchange rate applied by the customer’s credit or debit card company, which we do not define or determine. Your debit or credit card will be charged once you submit your order. 

 

By submitting a credit or debit card number, you represent and warrant that your use of the card is authorised and that all information submitted is true and accurate, and you authorise us to charge the card tendered for all amounts payable based on the products ordered. 

 

You may be subject to validation checks and/or third-party authorisations during the ordering or payment process. 

 

All Ticket purchases are subject to applicable booking fees, card processing fees, and delivery charges (if any), which are clearly stated at the point of purchase. These fees are non-refundable under all circumstances except where explicitly stated in these Terms and Conditions. 

 

Tickets purchased may include a Chairity Donation which are clearly stated at the point of purchase. These donations are non-refundable under all circumstances except where explicitly stated in these Terms and Conditions. 

 

Booking Fees 

For Edinburgh’s Christmas, a booking fee of £1.25 per Ticket applies to all Tickets, capped at a maximum of £10 per transaction. 

 

For Edinburgh’s Hogmanay, booking fees are charged on top of the Ticket prices and are listed separately for each Ticket. These booking fees are applied per Ticket and are not capped. 

 

These fees are non-refundable under all circumstances except where explicitly stated in these Terms and Conditions. 

 

Charity Donations 

We work with a range of registered national and local reputable charitable organisations and projects, to share their message and support their cause. 

Tickets purchased may include a Chairity Donation which are clearly stated at the point of purchase. These donations are non-refundable under all circumstances except where explicitly stated in these Terms and Conditions. 

 

Accessibility 

A disabled customer in the UK who holds a valid Ticket is entitled to one free Ticket for their carer or a person providing personal assistance to them at the relevant Event in the UK subject to the person claiming the free Ticket on their carer or assistant’s behalf and producing a valid locally issued disability card. Assistance dogs are welcome, but other animals may not be permitted at the Event/attraction.  

 

Companion Tickets are required to be booked alongside the main attendee’s paid Ticket and by attending an Event using such a Ticket, the person doing so accepts responsibility for providing any support you require in accessing the Event and Venue, including in an emergency situation and warrants that they are capable of performing these services. 

 

Concession Tickets 

Concessionary tickets and discounts may be available, please check at point of sale. Only one Concession or Discount is available per Ticket. 

 

All Concessions and Discounts are subject to availability; they may be restricted to certain price levels and performances and can be withdrawn by Unique Assembly without notice. 

 

To avail of any 2-for-1 Ticket offer, please ensure that Tickets have been booked in multiples of 2 for this offer to apply. A 2-for-1 offer applies only to full price Tickets and only where specified as being applicable to Tickets for the relevant Event. 

 

Senior citizens, the unemployed, customers with disabilities, Young Scot, MU and Equity card holders, as well as all young people under the age of 16 and students in full-time education, may be eligible for concession-priced Tickets where available (Subject to availability). If concession Tickets have been booked, valid proof of concession for each Ticket must be shown at the box office/venue on entry. If proof cannot be shown you will be charged the full adult Ticket cost. 

 

Where EH discount or other concession Tickets are offered, they are only valid when accompanied by appropriate and valid proof of eligibility (e.g., ID, proof of address). If such proof is not presented at the time of collection or entry, Unique Assembly reserves the right to refuse entry or require the customer to pay the full standard Ticket price. 

 

Babes in Arms  

Where possible Unique Assembly operates a “Babes in arms” policy. Babies and very young children aged 18 months or under may be granted entry to a performance without a Ticket, provided they are then seated in the lap of their accompanying adult and do not take up a seat for themselves. This may not apply to certain Events, and it is the Ticket holder’s responsibility to check the relevant Event listing to confirm if any Event-specific babes in arms policy applies. 

 

Resale Of Tickets 

You may not resell or Transfer a Ticket if prohibited by law. Any resale or transfer (or Attempted resale or transfer) of a Ticket in breach of the applicable law is grounds for seizure or cancellation of that Ticket, and no refund or exchanges will be made on that Ticket afterwards. 

 

We have a zero-tolerance policy on the unauthorised resale or touting of Tickets. If a Ticket is found to have been purchased or resold via an unauthorised platform, we reserve the right to cancel the Ticket without refund and to deny entry to the holder of such Ticket. Tickets may not be sold for more than face value. 

 

Unauthorised resale platforms include, but are not limited to, Viagogo, StubHub, eBay, Tixel, and Tickets. We reserve the right to add to this list and will take appropriate enforcement measures, including liaising with authorities if required. 

  

After-Sales / Complaints 

Should you have any queries or complaints relating to your order, please contact our customer care team on [email protected], we will endeavour to acknowledge all customer correspondence within 5 working days. 

  

Marketing Offers 

Unique Assembly reserves the right to change these general Terms and Conditions which are applicable to all offers and discounts at any time without prior notice and will make the updated Terms and Conditions available on the Website.  By continuing to use the Website and/or purchasing Tickets after changes to the Terms and Conditions take effect, you will be deemed to have accepted the new Terms and Conditions.  

 

Ticket prices may be subject to change at any time without notice at Unique Assembly’s discretion. 

 

Offers and discounts are not transferable and cannot be used in conjunction with any other offer or discount. 

 

All offers, and discounts are subject to availability, can be changed or withdrawn without notice and may be available for a limited period only. 

 

Unique Assembly runs varieties of the offers which are communicated to customers publicly, via social media or privately for the particular audience. Regardless of the nature of these offers, any customer wishing to take advantage of these offers must ask a member of box office staff while they are making a purchase. 

  

Gift Vouchers 

Gift vouchers are valid for 18 months from the purchase date. 

Vouchers can be redeemed for Ticket purchases for any show as part of the Edinburgh's Christmas and Edinburgh's Hogmanay Events listed on the Websites. 

 

Vouchers cannot be redeemed for any other purchases such as merchandise, bar sales or catering. 

 

Vouchers can be redeemed online through the Unique Assembly website, in-person at a Unique Assembly Box Office or over the phone. 

 

If the full value of the voucher is not redeemed in a transaction the remaining credit will be available to use within the eligibility period using the same voucher code. 

 

The risk of loss for the gift voucher passes to the purchaser or designated recipient when sent electronically and Unique Assembly are not responsible if any gift voucher is lost, stolen, destroyed or used without your permission. 

 

Vouchers cannot be redeemed for cash. 

 

Refunds/Exchanges 

Unique Assembly operates a strict no refunds or exchange policy and will only offer refunds or exchanges where provided in these Terms and Conditions. 

 

All Ticket purchases are final, and Tickets are non-exchangeable and non-refundable. Exceptions apply only in the event of a cancellation or rescheduling. Should an Event be cancelled, rescheduled or where there is a material change to the programme of the Event, Ticket holders may be offered either (a) an exchange for Tickets to any rescheduled Event (subject to availability), up to the face value of the original Tickets, or (b) a refund for the face value of the Tickets.  

For the avoidance of doubt no refund of any card processing fees, booking fees, charity donations or other costs will be refunded. For the purposes of this clause a 'material' change to the programme of the Event is a change which, in Our reasonable opinion, makes the Event materially different to the Event that purchasers of the Ticket, taken generally, could reasonably expect. The use of understudies in a theatre performance or a change to (advertised or not performers and music line-up in events shall not be a material change. 

 

In the event that an outdoor Event is cancelled or curtailed due to adverse weather, our liability is limited solely to refunding the face value of the Tickets purchased. Card charges, delivery fees, booking fees, and any donations are non-refundable. No further compensation or liability will be assumed. 

 

Where such a refund is sought due to cancellation, rescheduling or a material change to the programme of the Event, you must bring this to Our attention as soon as possible upon becoming aware of such material change, cancellation or where the Event has been rescheduled, prior to the rescheduled Event. The refund for Ticket(s) equals the face value of such Ticket. No refund will be provided on card processing charges, delivery fees or booking fees. 

 

Refunds shall only be made to the person who purchased the Tickets and, when possible, is made using the same method as was used to purchase the Tickets except, at Our discretion, where payment was made by cash. 

 

Unique Assembly operates a strict no latecomers policy, and no refund will be issued to those who are late or have been refused entry to an Event. 

 

It is the Ticket holder’s responsibility to check the Venue/Event Arena for the Event they are attending and be at the Venue 20 minutes prior to the scheduled Event showtime. Our Tickets clearly state Venue name, sub-venue name, full address. Unique Assembly is not liable, and no refunds will be issued to those who might be given the wrong information from a member of the public or any member of staff regarding a Venue. 

 

These Terms and Conditions do not and shall not affect your statutory rights as a consumer. For further information about your statutory rights, contact Citizens Advice or the Department for Business Innovation and Skills. Please note that where you are purchasing a Ticket for an Event which is due to take place at a specific Venue or on a specific date and time, the right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply. 

 

Booking protection insurance may be offered to you as an optional additional purchase on certain Tickets. Please note, where this is offered on any Ticket, the insurance is provided by XCover, whose own terms and conditions of cover apply.  Unique Assembly does not provide this insurance.  For more information on the booking protection insurance offered by XCover, please visit XCover’s website

 

Refusal of entry 

Event Box Office staff reserve the right to refuse to sell a ticket at the venue to Ticket Buyers due to their own behaviour as suggested in, but not limited to, the examples below:  

behaviours in a manner which, in the reasonable opinion of the Box Office is likely to affect the enjoyment of other visitors; or 

uses threatening, abusive or insulting words or behaviour or in any way provokes or behaves in a manner which may provoke a breach of the peace; or 

in the reasonable opinion of the Box Office is under the influence of drugs or has consumed an excessive amount of alcohol; or 

fails, when required, to produce proof of identity or age; or 

commits any criminal or unlawful act while present at the Box Office 

 

Event and Venue staff reserve the right to refuse Ticket holder’s admission to the Venue/Event Arena in reasonable circumstances including for health and safety, licensing reasons or where a Ticket is void. 

 

No refunds will be given to Ticket holders who are refused entry or ejected due to their own behaviour as suggested in, but not limited to, the examples below:  

has behaved in the premises in a manner which, in the reasonable opinion of the Venue has, or is likely to affect the enjoyment of other visitors; or 

uses threatening, abusive or insulting words or behaviour or in any way provokes or behaves in a manner which may provoke a breach of the peace; or 

in the reasonable opinion of the Venue is under the influence of drugs or has consumed an excessive amount of alcohol; or 

fails, when required, to produce proof of identity or age; or 

commits any criminal or unlawful act while present at the Venue 

 

 

Photography  

By purchasing a ticket and attending an Event, Ticket Holders consent to being photographed, filmed and sound recorded as part of an Event audience (without payment), and to the Ticket Holder’s image being used by Unique Assembly in all matters relating to the Event and any future promotions. 

 

Seated Venues 

Events may have unreserved seating and cannot guarantee all members of a party will be seated together, please check the Event prior to booking your Tickets. 

 

Ticket holders must comply with all relevant statutes, safety announcements and Venue regulations whilst attending the Event. If Ticket holders have any special requirements or concerns about any special effects which may be featured at the Event, prior notice should be given to the Venue. Special effects may include, without limitation, sound, audio-visual, pyrotechnic effects or lighting effects.  All Events are attended at the attendee’s own risk and the Venue may not be able to accommodate any special requirements notified to it. 

 

Any complaints about a Tickets holder’s seating or ability to view a production should be made promptly to the management staff of the Venue either before or *during the Event (*Within the first 15 minutes of the start of the Event). Any complaints made after the Event will not be considered and no refund or exchange will be issued. 

 

Unless otherwise stated and where applicable, seating will be offered on a first-come, first-served basis. However, we reserve the right to allocate seating in accordance with local Government rules and guidelines, which may result in groups being seated separately. This clause applies only to Events where seating is provided and does not apply to Events advertised as all-standing. 

 

Event Changes and Event-Specific Conditions 

We reserve the right to amend Event schedules, scheduled performers and performance timings (advertised or otherwise) without prior notice and without liability.  

 

No refunds or compensation will be offered to a Ticket Holder for the non-appearance of any advertised (or otherwise) Event Performer. 

 

Specific rules, safety protocols, and conditions of entry may vary depending on the Event.  

  

Limit Of Liability  

Admission to an Event and associated areas are at Your own risk. To the fullest extent permitted by law, Unique Assembly excludes all liability to a Ticket Holder for any loss, injury or damages sustained within a Venue or any associated areas (other than negligence by the Promoter which gives rise to personal injury or death.) Unique Assembly will not be liable to a Ticket Holder for any special, indirect or consequential damages resulting from attendance at an Event. 

 

Personal arrangements including travel, accommodation or hospitality relating to the Event which has been arranged by You are at your own risk. Our and the Event Partner(s)’ liability to You in connection with the Event (including, but not limited to, in the event of cancellation, rescheduling or material change to the programme of the Event) shall be limited to face value of the Ticket but excluding card processing charges, booking fees, donations or the per transaction collection or delivery fee. 

 

Neither We nor the Venue nor the Event Partner(s) will be responsible for any loss, injury or damage to any person (including You) or property howsoever caused (including by Us and/or by Event Partner(s):  

(a) in any circumstances where there is no breach of a legal duty of care owed by Us or the  Event Partner(s);  

(b) in circumstances where such loss or damage is not a reasonably foreseeable result of any  such breach (save for death or personal injury resulting from Our negligence); or  

(c) to the extent that any increase in any loss or damage results from breach by You of any of these Terms and Conditions and/or any terms and conditions of the Event Partner(s). 

 

Nothing in these Terms and Conditions seeks to exclude or limit Our or the Event Partner(s)’ liability for death or personal injury caused by Our or the Event Partner(s)’ (as relevant) negligence, fraud or another type of liability which cannot by law be excluded or limited. 

 

Events beyond our Reasonable Control (Force Majeure) 

For the purposes of these Terms and Conditions, ‘Force Majeure’ means any cause beyond Our control, including, without limitation, royal demise, act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, theft of essential equipment, malicious damage, strike, lockout, weather, third party injunction, national defence requirements, acts or regulations of national or local governments. We will not be liable to You for failure to perform any obligation under these Terms and Conditions to the extent that the failure is caused by Force Majeure. This Clause does not affect the terms of Clause 9.1-9.3 CHECK NEW NO. AS PER ORIGINAL TERMS 

  

General 

These Terms and Conditions, and any terms and conditions applicable to the relevant Venue and the Promoter and any specially agreed terms constitute the entire agreement between the parties in connection to, its subject matter and supersede any previous terms and conditions, agreement or arrangement between the parties. Each of the parties agrees that it has not entered into these Terms and Conditions in reliance on, and shall have no remedy in respect of, any statement, representation, covenant, warranty, undertaking or indemnity (whether negligently or innocently made) by any person (whether party to any contract entered into pursuant to these Terms and Conditions or not) other than as expressly communicated by Us to You before You have completed Your purchase or set out in these Terms and Conditions. Nothing in this clause shall operate to limit or exclude any liability for fraud. 

 

If any provision of these Terms and Conditions is found by a competent court to be invalid or unenforceable, that provision shall be deemed to be omitted from these Terms and Conditions and this shall not prevent the other provisions from continuing to remain in full force and operate separately.  

 

If any provision of these Terms and Conditions is or becomes illegal, invalid or unenforceable pursuant to the law of any applicable jurisdiction, this shall not affect or impair the legality, validity or enforceability in that jurisdiction of any other provision of these Terms and Conditions. 

 

These Terms and Conditions are governed by and shall be construed in accordance with the laws of Scotland, and you agree to submit to the non-exclusive jurisdiction of the courts of Scotland in relation to any dispute arising out of or in connection with these Terms and Conditions.

Specific rules, safety protocols, and conditions of entry may vary depending on the Event.  

 

Overall Festivals Conditions 

Whilst visiting any Unique Assembly Event/Attractions, you may be filmed or photographed in crowd shots for marketing, archive and promotional activities that may also feature on our social media channels. By purchasing a ticket and/or attending an Event, you consent to us capturing images of you and using these images as described. Please alert a member of staff if you object to being featured or refer to our Privacy Policy for further information. 

 

Audience members are not allowed to bring any form of recording or copying equipment (in whatever medium, including optical devices such as Google Glasses) into the auditorium of any Venue. Recording or copying equipment taken into the auditorium may be confiscated by members of staff. You are reminded that it is a serious criminal offence to copy or attempt to copy any material performed live on the stage, soundtrack or other copyright protected material shown at the Events and customers found in contravention will be asked to leave the Venue, will be asked to delete the footage/s that customer might have recorded or taken and no refund of any Ticket price.  

 

Anyone under 16yrs must be accompanied by an adult over 18yrs of age at all times (please see specific event conditions for age restrictions, if applicable). 

 

In the interest of safety, security and other reasonable causes, Unique Assembly or Venue staff reserve the right to search a customer’s possessions whilst on the Venue premises or at the point of entry for any item which a staff member believes may contravene these terms and conditions.  

 

Unique Assembly reserves the right to refuse entry or require a customer, who doesn’t agree to be searched, to leave the premises without entitlement to a refund 

 

No Glass can be brought into any venue or event arena. Ticket Holders are requested to drink responsibly. 

 

Neither alcohol nor hot food may be brought onto any Venue or Event Arena including Event Partner venues.  Only hot food bought on the premises at such Venue may be consumed on the premises. Alcohol can only be purchased and consumed in licensed bar areas at the Venues or in-licensed Venues and licensing laws will be strictly enforced. *Street Party does allow alcohol to be brought into the arena but only in plastic containers and cans not exceeding 500ml. 

 

No illegal substances or weapons are permitted into the Event Arena/Venue premises. Anyone found in possession of such items will be refused entry or will be required to leave the premises immediately without any entitlement to a refund. Unique Assembly works very closely with the police and other law enforcement services and takes such matters seriously and may report the incident to the police. 

 

Ticket Holders are requested to dress appropriately for the weather conditions as the majority of Edinburgh’s Winter Festivals events and attractions are outdoors. 

 

Re-entry to any Venue or Event Arena is not permitted (i.e. leaving the Venue and trying to gain re-entry). If a Ticket Holder leaves the Arena/Venue, they will NOT be permitted back into the Venue. 

 

Ticket holders must comply with all relevant statutes, safety announcements and Event Arena/Venue regulations whilst attending the Event and follow safety instructions as instructed by event personnel including event stewards, security, or emergency services. 

 

If Ticket holders have any special requirements or concerns about any special effects which may be featured at the Event, prior notice should be given to the Venue. Special effects may include, without limitation, sound, audio-visual, pyrotechnic effects or lighting effects.  All Events are attended at the attendee’s own risk and the Venue may not be able to accommodate any special requirements notified to it. 

 

All mobile devices including mobile telephones may be required to be switched off during Indoor Performances. 

 

Unique Assembly is not responsible for the parking regulations, fines, policies or conditions for the use of parking areas or spaces imposed by third party operators, including any cost imposed on customers. Customers should take up any issues directly with the third party concerned. 

 

Unique Assembly or the Event Partner reserves the right to make alterations to the published Event programme where reasonably necessary. 

 

The Event and Venue staff reserve the right to require that Ticket holders leave the premises at any point on reasonable grounds and may take any appropriate action to enforce this right.  

 

By way of example and without limitation, they may remove a Ticket holder who: 

has behaved in the premises in a manner which, in the reasonable opinion of the Venue has, or is likely to affect the enjoyment of other visitors; or 

uses threatening, abusive or insulting words or behaviour or in any way provokes or behaves in a manner which may provoke a breach of the peace; or 

in the reasonable opinion of the Venue is under the influence of drugs or has consumed an excessive amount of alcohol; or 

fails, when required, to produce proof of identity or age; or 

commits any criminal or unlawful act while present at the Venue; 

obstructs gangways, access-ways, exits, entrances safety lanes or staircases, congregates in non-designated areas or seeks entry to stands or seats for which he/she does not hold a Ticket.
